17. Jurisdiction and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India.
If any dispute arises in connection with these Terms, the services provided, or any related engagement:
- Both parties shall first attempt to resolve the matter amicably through discussion within thirty (30) days of the dispute arising.
- If unresolved, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
- The place of arbitration shall be Kolkata, West Bengal. Proceedings will be conducted in English.
- Subject to the above, the courts of Kolkata shall have exclusive jurisdiction over any matter relating to these Terms.
You waive any objection to such venue and consent to personal jurisdiction in these courts.
18. Force Majeure
Finiqus will not be held liable for any failure or delay in performance of its obligations under these Terms due to causes beyond its reasonable control, including but not limited to:
- Natural disasters
- Acts of terrorism
- Labor strikes
- Government restrictions
- Power outages
- System breakdowns or internet unavailability
Such causes will suspend our obligations for the duration of the disruption. We will take reasonable steps to restore service as soon as possible.

20. Entire Agreement and Severability
These Terms constitute the entire agreement between you and Finiqus regarding your access and use of the services. They supersede any prior agreements or understandings, oral or written.
If any provision of these Terms is found to be invalid or unenforceable, the remainder will remain in full force and effect. Any waiver of a provision must be in writing and signed by both parties.
The failure of Finiqus to enforce any right or provision under these Terms will not be considered a waiver of such rights.
